This Privacy Policy describes how, as a data controller, may collect, use, and share information, particularly in association with the instructions we receive to represent clients and in the operation of our website. This privacy policy relates to personal data that you provide to us. We do not accept any liability or responsibility in terms of the privacy and security practices of these third party organisations and their websites.

COMPLIANCE WITH THE GENERAL DATA PROTECTION REGULATION (“GDPR”)

The main principles are an important part of data protection law under the Data Protection Act 2018, and are at the core of the General Data Protection Regulation (GDPR). Whilst various principles can be found throughout the GDPR, Article 5 GDPR in particular sets out seven key principles related to the processing of personal data, which controllers (i.e. those who decide how and why data are processed) need to be aware of and comply with when collecting and otherwise processing personal data. These seven principles are:

  1. Lawfulness, fairness, and transparency;
  2. Purpose limitation;
  3. Data minimisation;
  4. Accuracy;
  5. Storage limitation;
  6. Integrity and confidentiality; and
  7. Accountability.

These principles are found at the outset of the GDPR, and inform and permeate
all other provisions of that legislation.

They should be understood as the fundamental overarching principles which aim to ensure compliance with the spirit of data protection law and the protection of the rights of individuals also known as ‘data subjects’.

Everybody working in and for Excel Barristers must comply with these principles in performance of their duties. The principles require us to ensure that all personal data and sensitive personal data are:

  1. Processed lawfully, fairly and in a transparent manner in relation to the subject;
  2. Collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  3. Adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  4. Accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
  5. Kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which personal data are processed;
  6. Processed in a manner that ensures appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage using appropriate technical or organisational measures;
  7. We must be able to demonstrate its compliance with (1) – (6) above in other words.

1. Information we may collect from you
i. When you receive a service from our website, we may ask you for personal data and other information to allow us to provide you with the services that you require. This could include the following:

  • Full name
  • Email address
  • Telephone number
  • Details of your enquiry
  • Name of your organisation

2. The internet is not secure. We cannot guarantee the security of your personal data transmitted through our website or by email. Any transmission is at your own risk. Some of the information you provide to us as a data subject may be considered sensitive personal data as defined under the General Data Protection Regulation and the Data Protection Act 2018. This means information about your ethnic or racial origin, political opinions, religious beliefs, trade union membership, physical or mental health, sexual life or criminal record. Sensitive personal data will only be processed following your explicit consent.

3. How do we intend to use your personal data?

In providing a service to you, we may contact you for reasons relating to the service for which you have enquired. We would use your contact details to manage this and may retain them for marketing purposes.

4. Will my personal data be shared with other organisations?

i. Your personal data provided by you via our website will be only used by Excel Barristers. We are registered the Information Commissioner’s Office and adhere to strict security standards. Full details of our notified purposes can be viewed at the website of the Information Commissioner’s Office ICO.

ii. In exceptional circumstances, if the law requires it, we may pass your personal data to another person or organisation to use for their own purposes. We will not otherwise disclose your personal data to anyone outside Excel Barristers to use for their own purpose without telling you.

5. How long will Excel Barristers. retain my personal data?

i. We will retain your personal data for as long as is necessary for the required service to be provided to you. All retained personal data is subject to the controls of our data protection policy and will be securely disposed of when it is considered to be of no further use.

6. Where will my personal data be kept?

Once we have received your personal data we will use recognised industry-standard procedures and security features to try to prevent unauthorised access.
Your personal data will be under the control of Excel Barristers.. It will be held on our computer system. Parts of our computer system, including our website and email, are provided by our UK suppliers of computer systems, and are provided for Excel Barristers sole use. When we print your personal data, this will be in the possession and control of our barristers at all times, and will be securely disposed of when it is considered to be of no further use to us.

7. YOUR RIGHTS
i. You have rights under the General Data Protection Regulation and the Data Protection Act 2018 which you can exercise at any time by writing to us at the address above. However please bear in mind that exercising your rights may make it difficult or impossible for us to provide you with services.

8. ACCESS TO YOUR PERSONAL DATA (SUBJECT ACCESS REQUESTS)
i. You have the right, under the General Data Protection Regulation and the Data Protection Act 2018, to be provided with a permanent copy of certain personal data that Excel Barristers holds about you. You have the right to know:
— any information available as to the source of your personal data
— the personal data of which you are a data subject
— the purpose for which we are using it
— the recipients to whom we have disclosed or may disclose your personal data.

ii. The General Data Protection Regulation and the Data Protection Act 2018 does not entitle you to see non-personal data or information about other data subjects. This information will be provided to you within 1 month of receiving your written request and payment of £25 (non-refundable) to cover our administration costs. To make a subject access request for your personal data, please post your request for the attention of Subject Access Request, Excel Barristers, 66 Daisy Hill, WF13 1LS. Please enclose your payment for £25 and make cheques payable to Excel Barristers.

9. MARKETING
We would like to contact our clients for marketing purposes This may be by post, telephone or email. If you do not wish to receive direct marketing from us, please contact us with your request.

10. COOKIES
Cookies are text files placed by our website onto your computer. They collect standard internet log and visitor behaviour information. The Excel Barristers website uses session and analytic cookies. Session cookies are temporary cookies that enable some of the functionality of our website. They remain in the cookie file of your internet browser until you leave the site. Analytic cookies enable us to monitor which pages you find useful and which you do not. We do not collect any personal data by using cookies. You can set your browser so it does not accept cookies, but this can affect the availability and functionality of our website
